Terms of Service

Brand Casa provides creative and marketing services on a subscription basis, including but not limited to brand strategy, design, web development, paid media management, and content creation.

The scope, deliverables, and timelines for each engagement are defined in the applicable subscription plan or statement of work agreed upon between Brand Casa and the client.

Upon full payment for services rendered, clients receive ownership of the final deliverables created specifically for them, unless otherwise stated in a separate agreement.

Brand Casa retains ownership of all pre-existing materials, tools, frameworks, and methodologies used in the creation of deliverables. We also reserve the right to showcase completed work in our portfolio, unless a non-disclosure agreement is in place.

Clients agree to:

• Provide timely feedback, approvals, and access to materials needed for project completion
• Ensure that all content and materials provided to Brand Casa do not infringe on third-party rights
• Use our services and deliverables in compliance with all applicable laws
• Maintain the confidentiality of any proprietary processes or tools shared during the engagement

Brand Casa's total liability for any claim arising from or related to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim during the three months preceding the event.

In no event shall Brand Casa be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of revenue, profits, or business opportunities.

Either party may terminate a subscription or engagement with 30 days' written notice. Upon termination, the client is responsible for payment of all services rendered up to the termination date.

Brand Casa reserves the right to suspend or terminate services immediately if the client breaches these terms, fails to make timely payments, or engages in conduct that is harmful to our team or reputation.

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be settled through binding arbitration.
